Program Tourism and Law Legislation

TOURISM LAW AND LEGISLATION 

CLASS III

PURPOSE.
To develop the ability to analyze social phenomena and operational planning with respect to the general interests that cannot be disregarded
To grasp the fundamental principles of the Italian legal system, also in comparison with other systems, both by analyzing its major changes underway and by highlighting its aspects of internationalization

OBJECTIVES
Explain with adequate and reasoned technical-legal language the concepts learned
Use, transversally, the logical procedures proper to legal thought
Recognize the essential legal categories that systematize socio-economic reality

MAIN TOPICS COVERED

  • Civil law-Know the characteristics of the legal norm, the sources, and in general the interpretation of the legal norm
  • Know the subjects of law
  • Know what a legal relationship is
  • Know the basic institutions of Family Law
  • Know how to distinguish property rights from possession
  • Understand rights of obligation and know what negotiating autonomy consists of
  • Recognize a lawful contract from an unlawful one
  • Know what contractual and non-contractual liability is
  • Know how to place some typical contractual institutions in the civil and commercial spheres.


CLASS IV

PURPOSE.
To develop the ability to investigate reality, through the process of abstraction and formalization proper to legal logic, develop the ability to synthesize and systematize in general categories

GOALS
To know how to read legal texts and sources
To know how to interpret the civil code and other sources of written law
To know how to compare legal solutions with actual solutions

MAIN TOPICS COVERED
1) Business Law
Know how an enterprise is established
Know how to distinguish enterprise and company based on their characteristics
Know the notion of "entrepreneur" and be able to classify the different figures of entrepreneurs
Know the tourism enterprise and the requirements that contribute to defining it as "tourism"
Know the differences between business corporations and nonprofit associations
Know the different types of contracts with tourism relevance: franchising, factoring, transportation, typical and atypical rentals
Know credit titles and legitimation documents

2) Administrative Law
Know the Constitution with regard to administrative decentralization (and the update in place)
Know the organization of the Public Administration at the central and peripheral levels
Know what are the subjects of the Public Administration
Know what the administrative activity of the state consists of
Know the tools for being able to object to administrative acts
Know the bodies to which to produce appeals


CLASS V

PURPOSES.
Holding firmly to the purposes acquired at the end of the fourth grade, those related to the end of the fifth grade should be:
Explain in technical-legal language
Develop the ability to investigate reality
Develop the ability to synthesize
Frame legal institutions in the European dimension

GOALS
To know how to use transversally the logical procedures proper to legal thought
To make stable connections with other disciplines by grasping the necessity of the legal norm
To interpret the norm, problematizing the interpretation in the consideration of individual and collective protected interests, particularly in the tourism sector
